PRIVACY AND COOKIES POLICY FOR VISITORS TO THE www.semidea.pl WEBSITE
This document sets out the principles of the Privacy Policy on the Website (hereinafter referred to as the “Website”).
DATA CONTROLLER
SEMIDEA spółka z ograniczoną odpowiedzialnością with its registered office at Jasna 6b, 05-123 Olszewnica Stara is the Administrator of personal data voluntarily provided by the Users, registered by the District Court in Warsaw, XIV Commercial Division of the National Court Register, KRS No.: 0000871938, NIP: 5361951676, REGON: 387818522, with a share capital of PLN 10,000.00, represented by the Management Board of the company. Personal data collected by the Website Administrator are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) and the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204). SECURITY OF PERSONAL DATA
The Administrator makes every effort to ensure that the data provided by the Users are properly secured: it does not transfer, sell or lend them to any institutions (except with the explicit consent of the User or at the request of authorized state authorities, i.e. law enforcement agencies, courts, etc. in the case of ongoing proceedings). Each person allowed on the part of SEMIDEA Sp. z o.o. to process personal data has been obliged to observe secrecy. In addition, the Administrator applies appropriate technical and organizational measures to properly secure the personal data of the Users processed by him. The Services available on the website (in particular the possibility of placing an Order) are not addressed to persons under 18 years of age. The Personal Data Controller does not provide for the intentional collection of data relating to persons under 18 years of age.
BASIS FOR PROCESSING PERSONAL DATA
Providing personal data by the Client is voluntary, although failure to provide the personal data necessary to conclude the Sales Agreement indicated in the Terms and Conditions results in a refusal to conclude the Sales Agreement. The data necessary to conclude the Sales Agreement are also indicated each time on the website of the online store. The basis for the processing of the Client’s personal data is the need to perform the contract to which the Client is a party or to take actions at the Client’s request prior to its conclusion.
SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING
The Users’ data are collected by the Personal Data Administrator in order to:
- in order to save and place an order, as well as to perform a sales contract concluded outside the entrepreneur’s premises (delivery of the purchased Goods), we process the personal data provided by you when ordering the Goods, such as name and surname, e-mail address, address data, payment data;
- in order to save and perform the brokerage agreement (delivery of the purchased Goods), we process the personal data provided by you when ordering the Goods, such as name and surname, e-mail address, address data, payment data;
- Personal data are used for the purpose of performing sales contracts, therefore they may be transferred to entities responsible for the delivery of purchased goods to the customer, including suppliers cooperating with the seller in the form of dropshipping.
- in order to consider complaints, complaints and requests and to respond to Clients’ questions, we process the personal data provided by you in the contact form, complaints, complaints and requests, or in order to answer questions contained in another form and some personal data provided by you in the Account, as well as data concerning the order of the Goods and other Services provided by us that are the reason for the complaint, complaints or applications and data contained in documents attached to complaints, complaints and applications;
- for the purpose of marketing our Goods and Services and our customers and partners, including remarketing, for this purpose we process personal data provided by you when creating an Account and updating it, data on your activity on the Website, including orders, which are registered and stored via cookies, and in particular order history, search history, clicks on the Website, login and registration dates, history and your activity related to our communications with you. In the case of remarketing, we use data about your activity to reach you with our marketing communications outside the Website and use third-party providers for this purpose. These services consist of displaying our communications on websites other than the Website. Details on this can be found in the provisions on Cookies;
- In order to organize competitions and loyalty programs, i.e. notifications about accumulated points, notification of winnings and advertising our offer, we use your personal data provided in the Account and when registering for a contest or loyalty program. Detailed information on this subject is provided each time in the terms and conditions of participation in a given competition or loyalty program;
- for the purpose of market research and opinions by us or our partners, i.e. information about the order, your data provided in the Account or during the purchase of the Goods, e-mail address. The data collected as part of market research and opinion research is not used by us for advertising purposes. Detailed guidance is provided in the information about the survey or in the place where you enter your data.
- in order to provide statistics on the use of individual functionalities available on the Website, to facilitate the use of the Website and to ensure the IT security of the Website, we process personal data concerning your activity on the Website and the amount of time spent on each of the subpages on the Website, your search history, location, IP address, device ID, data concerning your web browser and system operational system;
- for the establishment, pursuit and enforcement of claims and to defend against claims in court proceedings and other enforcement authorities, we may process your personal data provided when ordering Goods or opening an Account and other data necessary to prove the existence of a claim or which results from a legal requirement, court order or other legal process;
- On our websites, third parties place information in the form of cookies and other similar technologies on your end device (e.g. computer, smartphone) and gain access to them. These are our trusted partners with whom we constantly work to tailor to your needs and interests the advertising on our and their sites, as well as the services that we and our trusted partners provide. Such a trusted partner are entities from the Wirtualna Polski capital group.
Providing the required personal data by you is voluntary and is a condition for the provision of services by the Administrator of personal data via the Website.
DURATION OF PERSONAL DATA PROCESSING
Personal data will be processed for the period necessary to carry out orders, services, marketing activities and other services performed for the Client. Personal data will be deleted in the following cases:
- when the data subject requests the deletion of the data or withdraws the consent given;
- when the data subject has not taken action for more than 10 years (inactive contact);
- after being informed that the stored data is outdated or inaccurate.
Some data in the scope of: e-mail address, name and surname, may be stored for a period of another 3 years for evidentiary purposes, consideration of complaints, complaints and claims related to the services provided by the Website – these data will not be used for marketing purposes. Data relating to orders for Goods and Paid Services, competitions and loyalty programmes will be stored for a period of 5 years from the date of delivery of the order. We store data concerning Clients who are not logged in for the time corresponding to the life cycle of cookies stored on the devices or until they are deleted on the Client’s device by the Client. Your personal data regarding preferences, behaviour and selection of marketing content may be used as a basis for automated decisions to determine the sales opportunities of the Website. The personal data administrator will provide you with information about the actions taken in connection with your request without undue delay – and in any event within one month of receipt of the request. If necessary, the one-month deadline may be extended by another two months due to the complexity of the request or the number of requests. In any case, the Personal Data Controller will inform you of such extension within one month of receipt of the request, stating the reasons for the delay.
COOKIES AND OPERATIONAL DATA
When browsing the Website’s websites, “cookies” are used. Their use is aimed at the correct functioning of the Website’s websites.
- These cookies allow us to identify the software you use and tailor the Website to your individual needs.
- Cookies usually contain the name of the domain from which they originate, the time they are stored on the device and the assigned value.

THE RIGHT TO CONTROL, ACCESS AND DELETE THE CONTENT OF YOUR PERSONAL DATA
- You have the right to obtain information from the Administrator of personal data whether your personal data is being processed (Right of access to personal data (Article 15 of the GDPR).
- obtain information about the purposes of the processing, the categories of personal data processed, the recipients or categories of recipients of such data, the planned period of storage of your data or the criteria for determining this period, the rights you have under the GDPR and the right to lodge a complaint with a supervisory authority, the source of such data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of such data outside the Union European Union;

- If you have registered on the Website, you can rectify and complete your personal data yourself after logging in to the Website.
- You have the right to request the Controller to delete your personal data (right to be forgotten” (Article 17 of the GDPR) when:
- your personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
- you have withdrawn a specific consent, to the extent that the personal data was processed on the basis of your consent;
- your personal data has been unlawfully processed;
- you have objected to the processing of your personal data for the purposes of direct marketing, including profiling, to the extent that the processing of personal data is related to direct marketing;

- You have the right to request the restriction of the processing of your personal data The right to request the restriction of the processing of your personal data (Article 18 of the GDPR) when:
- you dispute the accuracy of your personal data – the Personal Data Administrator will limit the processing of your personal data for a period of time allowing to verify the accuracy of such data;
- when the processing of your data is unlawful and instead of erasure of your personal data, you request the restriction of the processing of your personal data;
- your personal data is no longer necessary for the purposes of processing, but it is necessary for the establishment, exercise or defence of your claims;
- when you have objected to the processing of your personal data – until it is determined whether the legitimate interests on the part of the Personal Data Administrator prevail over the grounds indicated in your objection.

- You have the right to object to the processing of your personal data, including profiling, at any time The right to object to the processing of your personal data (Article 21 of the GDPR), in connection with:
- processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes resulting from the legitimate interests pursued by the Personal Data Administrator or a third party;
- processing for direct marketing purposes.

- You have the right to receive your personal data from the Controller in a structured, commonly used and machine-readable format and to transmit it to another data controller (Right to request portability of personal data Article 20 GDPR).
- You can also request that it is the Personal Data Controller who transmits your personal data directly to another controller (if technically feasible).

- Right to withdraw consent
- You can withdraw your consent to the processing of your personal data at any time.
- The withdrawal of consent to the processing of personal data does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal.

If you believe that the processing of your personal data violates the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement. In Poland, the supervisory authority within the meaning of the GDPR is the President of the Personal Data Protection Office (PUODO).
